The proposed HITECH rules require covered entities to provide the recipient of any fundraising communication with a "clear and conspicuous" opportunity to opt out of receiving any further fundraising communications.
These are some details of the proposed HITECH fundraising rule:
The method offered for electing not to receive further fundraising communications may not cause the individual to incur an undue burden or more than nominal cost. As an example, HHS says requiring an individual to send a letter by mail to opt out of fundraising would constitute an undue burden.
Covered entities may not condition treatment or payment on an individual's choice with respect to receiving fundraising communications.
Providers and associates may not send fundraising communications to an individual who has elected not to receive such communications.
